These terms govern your use of Ads Batch Creator (“the Service”). By creating an account or connecting your Meta account, you agree to them. If you do not agree, do not use the Service.
1. What the Service does
Ads Batch Creator lets you create multiple Meta (Facebook and Instagram) ads in bulk. You select an existing ad to act as a template, upload media, and the Service creates new ads in your own Meta ad account based on that template.
The Service acts on your instruction and on your behalf. Every ad it creates is created in your ad account, under your Meta credentials, and is your responsibility.
2. Eligibility and accounts
- You must be at least 18 and able to enter a binding contract.
- You must provide accurate registration details and keep them current.
- You are responsible for keeping your credentials secure and for all activity under your account.
- You must have the right to access and advertise on any Meta ad account you connect.
3. Your responsibility for the ads you create
This is the clause that matters most. The Service is a tool that executes your instructions at scale — it does not review, approve or vet your advertising.
- You are solely responsible for the content, targeting, claims and legality of every ad you create.
- You must comply with Meta’s Advertising Standards, Community Standards and Terms of Service, and with all applicable advertising, consumer-protection and data-protection law.
- You are responsible for all advertising spend incurred in your ad account. The Service does not set budgets or control delivery.
- Creating ads in bulk does not reduce your obligation to check them. We strongly recommend reviewing a batch before it delivers.
Meta may reject ads, disable ad accounts or restrict users for policy breaches. Those decisions are Meta’s alone, and we have no ability to influence, appeal or reverse them.
4. Acceptable use
You must not use the Service to:
- create ads that are unlawful, deceptive, fraudulent or that infringe someone else’s rights;
- access a Meta ad account you are not authorised to use;
- circumvent, evade or interfere with any Meta enforcement action, review process or rate limit;
- probe, overload or disrupt the Service or its infrastructure;
- resell, sublicense or provide the Service to third parties without our written agreement;
- reverse-engineer the Service except where that right cannot lawfully be excluded.
5. Trials, fees and billing
- New accounts may receive a free trial. Its length is shown in the application when you sign up.
- After the trial, continued access requires a paid subscription. Prices are shown before you subscribe.
- Payments are processed by Stripe. By subscribing you also accept Stripe’s terms.
- Subscriptions renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period.
- Except where the law requires otherwise, fees already paid are non-refundable.
- We may change prices on reasonable notice. Changes never apply to a period you have already paid for.
6. Third-party platforms
The Service depends on the Meta Marketing API and on Stripe. We do not control those platforms. Changes to their APIs, policies, pricing or availability — including enforcement action against your account or ours — may interrupt or permanently limit the Service. We are not liable for those interruptions.
7. Availability
We aim to keep the Service available but do not guarantee uninterrupted access. We may suspend it for maintenance, security or technical reasons, and will give notice where reasonably practicable.
8. Intellectual property
We retain all rights in the Service, its software, interface and branding. You retain all rights in the media you upload and the ads you create. You grant us only the limited licence needed to host and process your content in order to provide the Service.
9. Suspension and termination
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate your access if you breach these terms, if your use creates legal or security risk, or if a payment fails and is not resolved.
- On termination your right to use the Service ends immediately. Data handling after termination follows our Privacy Policy.
10. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all implied warranties, including fitness for a particular purpose and merchantability. We do not warrant that the Service will be error-free, that ads created will be approved by Meta, or that they will achieve any particular result.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, nor for loss of profits, revenue, data, goodwill, or for advertising spend, ad-account suspension or business interruption.
Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
12. Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your use of the Service, the ads you create, or your breach of these terms or of Meta’s policies.
13. Changes to these terms
We may update these terms. If a change is material we will update the “Last updated” date and notify you by email or in the application. Continuing to use the Service after a change takes effect means you accept it.
14. Governing law
These terms are governed by the law of the jurisdiction in which the operator of the Service is established, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, save that consumers retain any rights to bring proceedings in their country of residence where the law gives them that right.
